Layer ordering issues with esri basemap

Email: even more FS IE stuff it is the imagery basemap that kills it

This one works:

so maybe it is the ESRI imagery basemap stuff

also I can load FS IE default, click Proceed, then unclick forest mask
and the state borders, which were on top, go UNDER the map
ugh
uncheck and recheck State Borders, and then they pop back up on top again
